My Value Skew Product apparently, is patented... Advice?

My biz partner and I found the perfect product for value skewing.. Its a fantastic idea, but the design has flaws, and the creator has done 0 marketing.. We were in the middle of designing and 3D printing our concept (Engineers by trade) and, working on some promo material to start going "Door to Door" next week.. Only to discover the creator actually does in fact have patent, even though it was never mentioned in his material. Sucks! For the first time in our lives we tasted the Fastlane, and want it.. Bad.. Any advice? (Our product will unfortunately fulfill ALL the claims mentioned on the patent but the design and materials used will change for the better. Thanks!!! @MJ DeMarco @Andy Black @LightHouse

Hi Ian, I would first research and thoroughly study the patent information and find something that your product does that the patent doesn't cover or a possibility of collaboration is also another option. Don't give up look for a way to make your product better.

Can you run a mini ad campaign to test the reaction? Make a fake website using Wordpress / Wix, put some Google / Facebook (Instagram) ads and see if people go to your website.

If they do, put a text and say something like "Our product is not out yet, but we'll send you a mail when it's out with a code for %20(?) discount."

Can you run a mini ad campaign to test the reaction? Make a fake website using Wordpress / Wix, put some Google / Facebook (Instagram) ads and see if people go to your website.

If they do, put a text and say something like "Our product is not out yet, but we'll send you a mail when it's out with a code for %20(?) discount."
Yes I definitely can, even if we don’t proceed because of this patent junk… it will be great practice! Thanks for the reply.

Either license it from the patent holder, or get an IP lawyer to examine to see if there is something materially different about your design. If it is in fact the same... there isn't much you can do there. Someone else already thought of it and created it.

once you are on the path of good ideas, don't stop just because you almost had it in your grasp, You guys can solve novel problems, your first at bat doesnt have to be a home run. Good luck.

The Chinese patent law question is not easy to answer; China has the most patent of any country in the world. That said, only about %10 of their patents are filed internationally for approval out of the 1.45 million filed each year in China.
