Hey everyone. So, at the moment my husband and I have created a product, brand, a logo and a name to go with it, the only issue is, is that we don't know if we can or should trademark it yet. It isn't a big brand and we can only sell it in our state at the moment...so should we wait until we grow or protect our brand now?

Start by doing a basic trademark search on Search trademark database

If there is other companies with trademarks in the same industry or similar industries to yours, then you may have trouble getting a trademark. It takes up to I believe 18 months to get a trademark approved after it is submitted, so you want to be confident that you will get the trademark before you go through the trouble of applying.

With that said, even if you aren't a big brand it is worth it getting it done sooner rather than later.
