To clarify, are you getting the legal seperation done by lawyers? I think investing cash in legal work would be worth it.

Have you spoken with a lawyer with expertise in this type of agreement? If your partner did not legally deliver, you should collect cash (depending on what the lawyer says). You can do it in a professional way, but every business needs cash. A certain degree of ruthlessness is, I believe, appropriate in this situation as it seems like your partner may have ripped you off.
