Can you explain what the issue was with your trademark and why it has cost you $20k in lawyer fees? How did the filing go wrong?
TLDR; the original Canadian registrations were done incorrectly, and as luck would have it, a US brand with the same name decided to attack our registrations. We hired incompetent lawyers by mistake, and we are now fighting to save the registrations through an appeal process that has to go through Federal court. Not fun, and not cheap!

We had Canadian trademarks registered in 2013 (DIY by the founder - first mistake) and everything was peachy until 2017 when a brand in the US started selling under the same name. Same name, same type of products. The brand in the US started getting good traction and they looked at expanding into Canada.

The US brand came after our trademark registrations in Canada with a Section 45 Proceeding (cancellation for non-use), even though we were still using the trademarks. Should be fine, right? We were still using the trademarks and had evidence to back them up.

At this point, we retained some local lawyers (not trademark lawyers, but general lawyers) to help us defend the S45 cancellation proceeding. The lawyers we hired let us know that our registrations were in jeopardy because the goods/services claimed on the original trademark registrations were incorrectly classified and did not protect the products we were selling.

The lawyers submitted evidence to CIPO to examine whether or not we deserved to keep the registrations. Unfortunately, the lawyers were not well-versed in these types of proceedings (second mistake), and the evidence we submitted was not sufficient to defend the cancellation. Our trademarks were ordered to be struck from the Canadian trademark register!

This started a big snowball effect of having to appeal CIPO's decision and finding competent (and expensive) trademark lawyers who had experience in these types of complex trademark matters and could help us. We had to dig up years' worth of evidence in order to prove that we were the first ones using the trademark in relation to the goods/services since in Canada and the US trademark rights are given to the first person/business to use the trademark in commerce, but you have to prove it, and it's expensive and time-consuming. This is why filing the trademark correctly the first time is extremely important.

I'm no longer a part of this business, although I am assisting my friend (the founder) through the process that is still ongoing today. The whole appeal has to go through a Federal court hearing still. Our company is not handling this case, but this was a big reason why I got into the industry. It seemed to me that is a gap between affordable and competent trademark services. These big-wig lawyers are literally charging to reply to emails and photocopies, as most lawyers do. But I don't agree with that. That's why we offer unlimited consultations and flat-fee pricing.

The short answer is: it depends. While it is certainly possible to register a trademark for a name, there are certain conditions that need to be met. In addition, just because you have a registered trademark does not automatically entitle you to own the domain name, again there are multiple requirements that need to be met to be successful in a UDRP proceeding.

A client approached us last week with evidence that a competitor was copying their brand name for a product. In cases like this, our client would normally contact the competitor and ask them to stop, but this competitor was not complying. We immediately sent out a cease and desist to the infringing party, and within the day all infringing material had been removed from the competitor's website and social media. This is the power of a registered trademark!

One of our clients got hit hard today. They lost all their Amazon listings just because some other company beat them to the punch and filed for the same trademark first, even though our client was using it for years. Now, we have to go through a lengthy process to get the other trademark canceled and prove to Amazon that our client is the true owner of the trademark.
