Business background: I own a website that provides online ordering for restaurant owners and their customers. Customers order from restaurant menus online and then choose from take-out or delivery. Their order is then sent to the restaurants via an automated telephone call. I receive the funds from the customer once the order is placed, then forward the payment to the restaurant on a weekly to monthly basis (they choose the time frame). I receive the order amount and taxes from the customer through my website, take 12.5% off the total order, then send the rest of the order payment to the restaurant.
My Question: How will I go about paying taxes? Do I need a resale tax license for this? My personal tax accountant says I might need one. If I am forwarding the full order amount (including taxes) to the restaurant, wouldn't it be the restaurant's responsibility to pay them? :coffee:
