Need Help (Even if i ask to a CPA ) Amazon FBA / Amazon KDP

Hi There

I am having trouble filling out the tax interview, i am a non us resident with an single member LLC formed in Wyoming. I have a EIN for my LLC.

I try to fill it out like this:

What is your tax classification?
Individual (Because “Individual” includes Single-Member LLCs where the owner is an individual)


For U.S. tax purposes, are you a U.S. person?
Yes (Because my LLC is a company created or organized in the United States or under the laws of the United States)


I enter the name of my company, registered address for the company, choose EIN on the dropdown menu (because i dont have SSN or ITIN) and when i try to proceed i get this erro r(this happen in others platforms too) :


The Name and Tax ID provided do not match IRS records. Please review your previous inputs and ensure the “Name” line is the correct name associated with the Tax ID provided.

You should complete the tax information for the individual or business that will report the income on a U.S. income tax return. If you are completing the tax interview on behalf of a single member LLC, generally the owner’s Name and Tax ID would be provided.



So even if I have an LLC i should use my personal data? (i have an US account where amazon pay me the royalties) And A CPA told me that i should use the form w8-ECI but i m not ETBUS ..... Any idea?

I ran into this exact issue on Amazon within the last month.

I called the IRS and confirmed the name and EIN that they had on file.

I do have a SSN and my LLC is a single member LLC. I'm not sure if Amazon is trying to make it mandatory to file under my SSN, but I'm not going to do that. That's what my EIN is for.

I have no clue what produced this error on Amazon, but I'd really like to know how to solve it.

This type of things are so confused even if you hire a CPA a lot of them are not sure about how to deal with that.

I´m still living in spain so if i need use my personal data i still can get a tax reduction in 0% but when i moved to costa Rica the next year looks like is not possible escape of 30% retention (even with the LLC)

Looks like first, i will need to incorporate my business in a country like Switzerland to skip that 30% and after pay me the salary to costa Rica

I believe if you are a SMLLC, you need to enter your personal details for Amazon.
If you live in a country with a US tax treaty (*cough*MostEuropeanCountries*cough*) then you may consider structuring your business(es) in a way that allows you to take a treaty-based position and not pay tax in the US anyway.

Thanks for your help, and yes i m agree that this is the most logic, even a cpa told me that i should use a W8-ECI when i m not ETBUS

So at the end looks like I will need to close my LLC and open a company in Switzerland that has a double treaty with the US so that way i don't lose the 30% of my royalties

Because my new country don't have this type of treaty like Spain have

PD : @CareCPA i will contact with you because i will need to present the Form 5472 the next year
