I subscribe to the Exchangors' newsletter, and today I received one of the creative ideas they promote to deal with different situations.
I am posting this one here as an example of creative ideas and a topic of discussion about the way to accomplish something like this --even better if you have actually done it.
"Swap Non-Performing Notes"
Situation - Our two exchangors, Able and Baker, each have some real estate
notes in their portfolios. These notes represent debts owed them by friends
and/or former clients. Problem is that the loans are not performing and
Able and Baker are reticent to foreclose on their friends and/or former
clients.
Solution - Able and Baker exchange notes with each other. They then become
holders of notes from people that they do not know or have any kind of
special relationship with. Able and Baker are now free to pursue their debt
remedies in a businesslike manner with their "new" debtors.
Discussion - It is an unfortunate truth that people are more likely to pay
a stranger on a note than they are a friend. People figure that "friends"
will understand. They don't have those expectations with a stranger.
