I have a patent related question. Our patent was granted for issuance but now my patent attorney is asking if I want to go forward with a second “continuation” patent. I’m curious to hear from anyone with experience and see if it really makes sense to go after a second patent. For background info the patent is utility/technology in eCommerce space. So far Ive put together notes for pros/cons:

Pros:
  • Added “insurance” that helps me protect my intellectual property
  • Can add additional claims if I see something similar in the marketplace
Cons:
  • Even if I see something similar I cant see their code so it is really that useful?
  • I have to search for other patents online and its a long/difficult process while I could be out working on my idea
  • Expensive – this money could be used to keep our server running.
I have one week to respond so really curious to hear from anyone on whether this makes sense to continue or simply take the original patent and celebrate with a good drink!
