So I've been reading an interview with Stephen Key, and he mentions an easier route by not creating/producing your own inventions, improving on things that are already selling. He also mentions getting a 1 Year patten just to be safe.

So I have an improvement for M&Ms. But would I be able to get a patten on it? (Its basically a new marketing gimmick they could use.)

And if I can't pull a patten, would Intellectual Property be enough to win me the case if they so happened to take my idea without paying me royalties?
