Im looking to bring a product to my home market (Ireland + UK) but I realised the product is being sold by a bunch of random vendors on amazon (all generics)
A few american companies have made simple modifications/branding and are selling the product 2-5 times the price of the generics.
After some research I found out none of the companies/vendors own the patent its owned by a single individual who sells a similar product who threatens to sue.
Can he really go after 100s if not 1000s of resellers, manufacturers across the globe ?
Exactly how does patenting work ?
There is always someone who came out with the original idea like a water gun for example. Soon enough tons of copycats flood the market and the winner grabs the most market share through better product/marketing. Lonnie Johnson patented super soakers but many other companies sell water guns possibly better but also very similar.
Another modern day example is the gopro which holds a bunch of patents relating to design yet several companies make similar goods with the same function.
So how does it work ? is it up to the patent holder to go after everyone possibly wasting their time.
I really don't want to get sued one month after importing, branding and marketing my first product.
