If the Supreme Court of the United States determines you need a manufacturer's permission to resell merchandise you acquired lawfully, it will change major components of channels of distribution for B2B and B2C resale.

I'll say a prayer. My confidence in this court to understand and rule on the Constitutionality of issues couldn't be lower.

I have a hard time believing they would alter first-sale doctrine. That'd just be nuts. That'd be the sort of thing that would have me seriously thinking about leaving the US. What an insane overreach that'd be.

There's a nice Fastlane story tucked away in all this though. The first article claims he made a million reselling the textbooks.

Amicus briefs (friend of the court white papers) are flying in all directions on this. It's not clear as to which way the Supreme Court will lean on this.

It would create a nightmare for everyone. Yard sales and swap meets would be all be scrutinized. Not to mention Ebay, Craigslist, Backpage, Amazon marketplace, Chegg, and classified used sales would all have issues. I can see them siding with Wiley, but add verbiage to allow commerce as we know it to continue. However to prevent situations that the case is based on, they will make rules to prevent this action based on certain criteria.
I hoping they don't change a thing, but it's hard to think they will stick with status quo given of how fast the world is changing and that America is deep in debt.
