Hi Fastlaners,

I am in the process of setting up a freelance site. I know there are tons of competitions out there, but i'm still doing it. My question is this for those that run online businesses. What are the chances of getting sued? I have crafted a nice disclosure form and stated that the site/business has no liability at all for the transactions and events that occur on the site.

How many of you that own online businesses faced lawsuits and how often do these types of things happen and how did you handle it?

Thank you

1. Avoid the legal system. Nobody usually wins.

2. Your disclosure form does very little to nothing to minimize your liability because

3. Anyone can sue anyone for any reason, at any time. I could sue you today if I wanted to. Frivolous lawsuits are not prohibited in the United States.

4. Don't spend another minute worrying about this. Press forward.

5. If you own a business, there's a high probability that if you become successful, someone will sue you some day. Spend no time worrying about that now, and when it happens down the road spend time figuring out how to resolve it outside of the legal system.

6. If you're really concerned about this, once you generate some money get some insurance for the business, maybe along the theme of an "errors and omissions" policy

Press on. Don't let fear invade your thought process.

So you think i should just get the business running and not worry at the start?

Don't have a lawyer on retainer at the start?

Your advice makes lots of sense, I just don't want to have problems and wanted to see what I could do to minimize it.

Actually, in order to sue someone, there has to be a case. (Causing emotional trauma, violation of contract, etc). However, good lawyers will always find a work-around to make a case. Great lawyers will give you the run around and have you take months or even years for you to make any progress in the case.
