Hello,

can you please recommend a good service for registering a trademark in US (and possibly in EU)?

I want to trademark my brand name.

Today, a Chinese domain registrar informed me, that they will register mybrandname.com.cn, mybrandname.cn, mybrandname.net.cn and a few other variants for a company in China.

I wonder, when I register my brand in the US, can I ask them to take those domains down?

Thanks.

This is a domain registry scam, wouldn't worry about this too much.
Thanks for replying, MJ.

The registrar in question is chinaregistry.org.cn, but the email came from a chinanetworks.org domain.

The sender was respectful, and said, that they've received a request from a certain company in China (which seems to be quite big - they are listed on a Chinese stock exchange) to register the mentioned domains and he wants to check, if that's not an issue.

I told him that it is an issue (because I wanted to register my brand name anyway), but then I got another email from @outlook.com email address saying, that they'll proceed with the domain registrations anyway.

I checked and the domains are now actually registered.

I guess, in reality, this won't be an issue. But if someone trademarks my brand name in the U.S., I guess I'm in trouble. That's why I want to trademark my brand name, so I won't have any major legal issues down the road.

Hi, let me know if you need some pointers or guidance with that. It would be a pleasure to help or put you in the right direction.

Hi, thanks for the offer.

I actually started an attorney-led trademark registration at LegalZoom ($599 + USPTO fees).

I want to sell on Amazon.com, too, so I guess it's best that I get this sorted ASAP.

If I have my brand registered in the US only, I can't force anyone else not use by brand name anyway. :-/

Great, Legalzoom is useful and they usually do it well.
You can also have an individual attorney to do it for that much and to be available to answer questions or explain any office action you receive later but all serious agencies and companies do the job in a proper manner.

Actually having your brand granted in any jurisdiction and being first in the use of the brand in commerce give you SOME protection. Specially being trademarked in big markets like the US. You can use the letters "TM" anywhere as well. (You can only use ® when is officially granted).

After that trademark is granted in USA you can try to do a massive cheap filing under the Madrid protocol. You are in the right path.

Thank you for the very useful info.

After learning it was a scam, I canceled the LegalZoom service, because I also learned that my domain name should not be in any danger, even if someone trademarks my brand name. It's basically "a first come, first served" type of situation and I didn't register it to make a profit from anyone.

However, I do plan to launch a separate brand for my ecom store.

If you're available for hire, we can do some business once I figure out my new brand name. :)

No need, I will consult whatever you need for free, that is the spirit of the forum.

No need to hire me, you can file the trademark with whoever you want, that is the easiest part to do.
