Selling a product in Europe, that is patented in the US?

I would like to manufacture a product in the EU that I think there might be huge demand for, but it is patented in the US. I haven't been able to find any patents in the EU and I don't think it is patented over here. The idea has been validated in the US already.

Do you think I might run into any possible legal issues in the future if I decide to pursue this venture?

What did your local lawyer tell you?

Several things come to mind:

. Patents don't concern products. They concern technologies.

. Patents are only relevant for a determined geographical space. In this case the USA.

. As far as I know there still isn't such a thing as European patents. In Europe at this point there are only national patents.
(Although in future European patents will be made possible).

. Whether patents are of any use in an entrepreneurial venture remains to be seen.
Any patent can be infringed upon successfully given enough money to pay the right patent lawyers.

Hope this helps.

You might run into trouble if they filed for PCT protection. The PCT is the patent cooperation treaty. In short, if you have a patent in a participating country you can file for and get what amounts to reciprocating protection in all the countries. That's a gross oversimplification. This is an internet forum post, not to be confused with the council you get when (NOT if) you talk to a local lawyer. Hopefully I have given you what you need to know what you are looking for.
