    Hello,

    I had an idea for a new product and after some research discovered it was already out there (sort of). I know this has happened to all of us plenty of times, but I think this is a little different in that I don't see it being marketed at all and the existing product is nothing like I envision it being designed.
    The biggest roadblock is an existing patent registered in the U.S. a few years ago. Same idea, but different design. Product was also being sold on a Hong Kong website but looks like it's discontinued and poorly designed. I would like to speak to someone who knows about patents, or even a patent attorney. Anyone know anyone? I was thinking I could buy the patent, if I need to. Thanks

    How about do it THE RIGHT WAY.

    Make some. See if you can sell them. If you can't - you didn't waste any time and will
    be satisfied that you successfully ruled-out that option - people just didn't want them
    and that is a success to figure that out before investing in UNIMPORTANT THINGS.

    If you sell enough, the patent owner MAY contact you and you can deal with it THEN
    The best thing would be to just CUT HIM IN ON PROFITS ( license royalty or better,
    just 5% of the company NET AFTER TAXES or DIVIDENDS without paying cash
    when you need it most. ) He will REJECT your first offer. But - you counter with this:

    - Dude, you're broke and your patent protects the unit because it didn't work the way
    you built it. Mine is better and does things better ad that's why people want mine, not yours.
    THE ONLY reason you are being offered this deal is so that your patent is not a barrier to
    my patent application which I'd need to sell the business 50 years from now - but I am
    prepared to continue without a patent and meet any legal challenge you put up.
    Before you decline the offer again - consult your legal counsel and figure out how much
    you'll owe them even if they are not successful with winning your case, because
    this is my final offer and if you create legal issues for me - you'll get absolutely nothing.
    This way is a guarantee.
